For us, responsible handling of personal data collected as part of our business operations is crucial to our business goals and reputation. This Privacy Policy explains how your personal information is collected and used when you are a customer of Yak Sport, and how you can access your own personal information.

What are personal data?

Personal data means any information about an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

What type of personal data do we process about you and why?

The information we collect about you will be used for various purposes in connection with your customer relationship and the operation of Yak Sport's business. Generally, it will include information related to customer administration and information regarding Yak Sport's rights and obligations.

Failure to provide personal information on your part may mean that Yak Sport will be unable to fulfill its obligations in connection with your customer relationship.

Yak Sport collects and processes primarily ordinary personal data. However, in specific cases related to booking a trip, it may be necessary for us to process sensitive personal data (e.g., information about special dietary requirements for your flight or information about the need for special assistance on your trip) in order to provide the desired trip to you. In these cases, Yak Sport will obtain a separate consent statement.

Yak Sport typically collects the following information:

Information you provide to us when booking a trip with us, online through the website or by contacting our travel consultants, including contact details (first name, middle name(s), last name, address, telephone number, email address, and date of birth), bank details, information you provide to us regarding your special preferences during the trip (e.g., information about special dietary requirements, need for special assistance in connection with disability or other illness, etc.), health information (for medical treatment trips, sports trips, etc.), membership of our partners' associations, membership of benefits and discount schemes, information you provide to us regarding your preferences for marketing or communication, and information you provide to us when contacting us with a question, to report a problem, or otherwise contacting us in connection with your customer relationship with us.

What do we use your personal data for?

Yak Sport processes your personal data to fulfill the purposes listed below.

Yak Sport processes only your personal data to the extent necessary in connection with your customer relationship or in accordance with applicable law.

5.1 Customer Administration

Yak Sport processes your personal data in connection with the creation and ongoing administration of your customer relationship with Yak Sport as part of the operation of our business, including booking trips and delivering our other products (such as visa applications, travel insurance, transfer services, etc.), maintaining our customer records, invoicing, marketing, statistics, etc. All statistics and analyses are prepared in anonymized format and therefore do not contain information that can be directly attributed to you as an individual.

5.2 Compliance with Applicable Laws and Regulations

Yak Sport processes your personal data in connection with compliance with laws and regulations that Yak Sport is subject to in connection with the operation of the business or to fulfill various reporting or disclosure obligations in accordance with applicable laws and regulations.

Yak Sport does not use your personal data to make decisions that are based solely on automated processing, including profiling.

Legal Basis for Processing Your Personal Data

Yak Sport processes your information based on one of the following legal bases: (1) Your consent, (2) entering into or fulfilling your contract with Yak Sport, (3) Yak Sport's legitimate interests, i.e., the purposes described above, (4) compliance with a legal obligation imposed on Yak Sport, (5) protecting your or another natural person's vital interests, (6) processing is necessary for the establishment, exercise or defense of legal claims, and (7) processing is necessary for compliance with Yak Sport's or your legal obligations arising from national law or EU law. Additionally, there may be situations where we process your personal data for the legitimate interests of third parties concerning the purposes described above, unless your interests outweigh those interests.

Sharing of Personal Information

Yak Sport only discloses information to the extent necessary as part of our business operations, including providing your travel and other products purchased with us.

Yak Sport typically shares personal information with the following recipients in connection with booking a trip and related products:

7.1 Airlines

Yak Sport discloses personal information to airlines in connection with booking your trip. For booking your flight, we typically provide information such as first name, middle name(s), last name, departure airport, destination, date of departure and return, special requests for your trip, including ordering special meals during the flight and any need for special assistance on the plane or at the airport for the chosen airline.

7.2 Hotels

Yak Sport discloses personal information to the hotels you will be using on your trip. For booking your hotel accommodations, we typically provide information such as first name, middle name(s), last name, destination, date of arrival and departure, room category, special requests for your trip, including any need for special assistance during the hotel stay due to disability or illness.

7.3 Bus Companies

Yak Sport discloses personal information to bus companies if you are taking a bus trip as part of your journey (e.g., airport-hotel-airport transfer or in connection with day trips to tourist attractions, etc.). For booking your bus trip, we typically provide information such as first name, middle name(s), last name, pick-up location, date and time of the bus trip, destination, and any special requests for the bus trip, including ordering special meals during the bus trip and any need for special assistance during the bus trip due to disability or illness.

7.4 Travel Agents

If, as part of your journey, you participate in excursions, Yak Sport may disclose personal information to travel agents. The travel agent is responsible for arranging the specific excursion by ordering the desired services from local suppliers at the destination. For booking your excursions, we typically provide information such as first name, middle name(s), last name, date and time of the excursion, type of vehicle, destination, and any special requests for the excursion, including ordering special meals and any need for special assistance due to disability or illness.

7.5 Insurance Companies

As part of booking your trip with us, you have the option to purchase travel and/or cancellation insurance. If you wish to purchase such insurance, we will disclose personal information to the insurance company for the purpose of insuring with them. For the purpose of taking out travel and/or cancellation insurance, we typically provide information to the insurance company such as first name, middle name(s), last name, email address, date of birth, destination, date of departure and return, and type of trip.

7.6 Equipment Rental Companies

As part of booking your trip with us, you have the option to rent any equipment you may need for your trip, such as golf equipment, diving equipment, and the like. If you wish to rent such equipment, we will disclose the information to the company at your destination from which you will be renting the equipment. For equipment rental, we typically provide information to the rental company such as first name, middle name(s), last name, type of equipment, pick-up location, rental period, and information about height, weight, clothing, and shoe size.

7.7 Special Offers

When you choose Yak Sport, you have the option to receive a qualified offer for a trip. A qualified offer is an offer where, in connection with the preparation of the offer, a preliminary reservation of the desired trip is made for you. This allows you to reserve a seat on the desired departures for up to three days before deciding whether to issue a ticket for the preliminary reservation or cancel it.

To submit a qualified offer, we disclose the information about you and the desired reservation to airlines and our local agents who make the preliminary booking with the hotel, bus company, etc.

Since, in connection with obtaining the qualified offer, personal information is disclosed to several new independent data controllers (airlines, local agents, hotels, bus companies, etc.), your information may be retained by these recipients after the offer expires – even if the offer is canceled.

Yak Sport may also disclose and/or transfer your personal information to other suppliers and/or service providers in connection with the normal operation of our business, e.g., external administration of our IT systems, analysis tasks, marketing tasks, credit assessment, auditing, legal assistance, etc.

Yak Sport seeks to limit the disclosure of personal information in personally identifiable format to the greatest extent possible to limit cases where information that can be attributed to you personally is disclosed.

Yak Sport does not disclose your personal information unless it is necessary to conduct our business or meet your needs.

International Transfers of Your Personal Information

Due to the nature of Yak Sport's business, your personal information may be transferred to countries outside the EU/EEA in connection with booking a trip with us. To deliver our services to you, we need to use partners and suppliers outside the EU/EEA in certain cases.

Without the ability to transfer your information to recipients outside the EU/EEA, Yak Sport would be unable to provide the desired trip to you. This applies if booking your trip requires transferring information to recipients outside the EU/EEA, for example, to book flights, hotels, etc., at your travel destination.

Data protection laws in these countries may be less stringent than they are in Denmark and the rest of the EU/EEA, as, in most cases, they will be countries where the EU Commission has assessed that the level of data protection is not equivalent to the level of data protection within the EU/EEA.

In cases where practical, the transfer of your personal information will be based on the standard transfer contracts developed by the EU Commission specifically for this purpose. Regarding transfers to the USA, these will, as far as possible, be based on Privacy Shield. Privacy Shield is an agreement between the EU and the USA that establishes a strong set of data protection rules and security measures that US companies participating in the scheme are obliged to comply with when processing personal information.

In certain cases, however, it may not be practical for Yak Sport to enter into a standard transfer contract or use Privacy Shield as the legal basis for the transfer. In such cases, the transfer of information will be based on Article 49(1)(b) of the Data Protection Regulation, as the transfer of your personal information to the country in question is necessary for the performance of the contract between you and Yak Sport (booking your trip) or for the implementation of measures taken at your request prior to entering into such a contract (e.g., in connection with submitting a qualified offer as mentioned above in section 7).

It is therefore important that you are aware that the transfer of your personal information to countries outside the EU/EEA in connection with booking a trip with Yak Sport means that your personal information will not enjoy the same protection as under Danish or EU legal rules.

In connection with the transfer of information, there is a risk that the country in question does not have clear, precise, and accessible rules on the authorities' access to your personal information; that there are no rules that the authorities' access to your information must be necessary and proportionate; that the country does not have an independent and effective supervisory authority, and that the country does not have accessible and effective remedies for data subjects.

If you do not want Yak Sport to send your personal information to recipients outside the EU/EEA in connection with booking your travel(s), please inform us no later than when booking your trip.

Yak Sport does not disclose your personal information to recipients outside the EU/EEA under any circumstances, unless it is necessary to conduct our business and meet your needs, such as delivering the desired trip to you.

Data Integrity and Security

Personal data is not stored for longer than necessary to fulfill the purpose for which it was collected, unless storage is necessary to fulfill national legal requirements, including statutory retention periods in connection with accounting, etc.

It is Yak Sport's policy to protect personal data by taking adequate technical and organizational security measures. We will ensure that your personal information is securely deleted after 5 years.

Your Rights

You have the right at any time to exercise your rights under the applicable data protection legislation. Among other things, you can request insight into the personal information that Yak Sport holds, and object to the processing of the information, including objecting to the use of your personal information for direct marketing. Furthermore, you can request correction or deletion of any incorrect information about yourself, withdraw consent to the processing of your personal information, and exercise your right to data portability.
